Welcome to the DriveEasy Partner App ("Service"), operated by DriveEasy ("Company", "We", "Us", or "Our"), a platform connecting driving school owners and instructors with learners in Telangana, India. These Terms and Conditions ("Terms") govern Your use of the DriveEasy Partner App as a School Owner or Instructor ("You" or "User"). By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, please do not use the Service.

These Terms apply to all Users of the DriveEasy Partner App, including School Owners managing driving schools and Instructors providing training services. Please read these Terms carefully, as they form a legally binding agreement between You and the Company.

Definitions

For the purposes of these Terms:

• Account means a unique account created for You to access the Service or parts of the Service.
• Application refers to the DriveEasy Partner App, the software program provided by the Company for School Owners and Instructors.
• Company refers to DriveEasy, the entity providing the DriveEasy Partner App, based in Telangana, India.
• Instructor means an individual providing driving training services through the Service.
• School Owner means an individual or entity operating a driving school and managing bookings, instructors, or vehicles through the Service.
• Service refers to the DriveEasy Partner App and related services provided by DriveEasy, including booking management, analytics, and learner connections.
• User means any School Owner or Instructor accessing or using the Service.
• You refers to the User accessing or using the Service.

Eligibility and Account

Eligibility

To use the Service, You must:

• Be at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872.
• Hold a valid driving license (for Instructors) or operate a registered driving school (for School Owners) in compliance with applicable laws.
• Provide accurate and complete information during Account registration, including identification documents (e.g., Aadhaar card, PAN card, driving license) when required for verification.

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of Your Account login credentials.
• All activities conducted through Your Account.
• Immediately notifying Us of any unauthorized use or security breach.
• Ensuring all information provided is accurate, current, and complete.

We reserve the right to suspend or terminate Your Account if You provide false information or violate these Terms.

Use of the Service

License

We grant You a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose, subject to these Terms.

Services Provided

The DriveEasy Partner App enables:

• School Owners to manage bookings, payments, vehicles, instructors, and analytics.
• Instructors to schedule training sessions, manage learner progress, and submit required documents.
• Connection with verified learners seeking driving training.

We provide the Service on an "as-is" basis and may update or modify features at Our discretion.

Zero-Commission Policy

DriveEasy does not charge commissions or upfront fees to School Owners or Instructors for using the Service. You retain all earnings from learner bookings, subject to applicable taxes and payment gateway fees (if any).

User Obligations

You agree to:

• Use the Service in compliance with all applicable laws, including the Motor Vehicles Act, 1988, and Digital Personal Data Protection Act, 2023.
• Maintain valid licenses, permits, and insurance for vehicles used in training.
• Provide accurate booking and availability information.
• Ensure vehicles are roadworthy and meet safety standards.
• Comply with Our Privacy Policy regarding learner data.

Payments and Fees

School Owners and Instructors are responsible for:

• Setting and collecting fees from learners for training services.
• Ensuring timely payment processing through the Service’s payment gateway (if applicable).
• Bearing any taxes, levies, or payment gateway fees imposed by third parties.

We do not deduct commissions but may charge nominal fees for premium features (if introduced), which will be communicated in advance.

User Conduct

You agree not to:

• Use the Service for any unlawful or unauthorized purpose.
• Misrepresent Your identity, qualifications, or services.
• Engage in unprofessional behavior, harassment, or discrimination toward learners or other Users.
• Interfere with the Service’s functionality, including uploading malware or attempting unauthorized access.
• Use learner data for purposes beyond providing the Service, except with explicit consent.

Instructors must maintain a professional and approachable demeanor, as outlined in Our branding guidelines (e.g., wearing DriveEasy-branded attire when representing the platform).

Intellectual Property

All content, trademarks, logos, and software in the Service, including the “DriveEasy” name and logo, are owned by or licensed to the Company. You may not copy, modify, distribute, or use Our intellectual property without prior written consent.

You grant Us a non-exclusive, royalty-free license to use any content You upload (e.g., instructor profiles, school logos) for the purpose of providing and promoting the Service.

Termination

We may suspend or terminate Your access to the Service, with or without notice, if You:

• Violate these Terms.
• Engage in conduct that harms learners, other Users, or the Company’s reputation.
• Fail to maintain required licenses or certifications.

You may terminate Your Account at any time by contacting Us. Upon termination, Your license to use the Service ends, but certain obligations (e.g., confidentiality, indemnification) survive.

Liability and Disclaimers

Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for:

• Any direct, indirect, incidental, or consequential damages arising from Your use of the Service.
• Loss of profits, data, or business opportunities.
• Actions or omissions of learners, other Users, or third parties.

Our total liability shall not exceed INR 1,000 or the amount paid by You to Us (if any) in the preceding 12 months.

Disclaimers

The Service is provided “as-is” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted access. We do not guarantee learner bookings or earnings.

Indemnification

You agree to indemnify and hold the Company harmless from any claims, losses, or damages arising from Your use of the Service, violation of these Terms, or infringement of third-party rights.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Hyderabad, Telangana. Any disputes shall be resolved through good-faith negotiation, failing which, through arbitration in Hyderabad under the Arbitration and Conciliation Act, 1996, with one arbitrator appointed by the Company.

Changes to These Terms

We may update these Terms from time to time. We will notify You of changes by posting the updated Terms on this page and, where required, via email or in-app notification. Changes are effective upon posting, and Your continued use of the Service constitutes acceptance constitutes acceptance.
